This Privacy Policy explains how MyEats LLC. (“MyEats,” “we,” “our,” or “us”) collects, uses, discloses, and otherwise processes personal information when you use our Services (including our website, mobile application, and other interactions you may have with us).

1. Who This Policy Applies To

This Privacy Policy applies to personal information we process about you when you:

  • Create an account or use the MyEats mobile app;
  • Visit or use our website;
  • Communicate with us (including support and chatbot interactions);
  • Participate in surveys, research, promotions, or events; or
  • Interact with MyEats through social media, forums, or other public-facing community features sponsored by or affiliated with MyEats.

2. Eligibility and Children’s Privacy (18+ Only)

MyEats is intended for adults. You must be at least 18 years old to use the Services.

  • The Services are not designed or intended for children or anyone under 18.
  • We implement technical measures intended to prevent individuals under 18 from creating an account or using the Services.
  • If we become aware that an individual under 18 has provided personal information, we will investigate and, if applicable, take steps to remove the data and delete that individual’s account.

3. Personal Information We Collect

We may collect personal information:

  • Directly from you (for example, when you create an account or use certain features);
  • Automatically (for example, through cookies and similar technologies when you use our website, or through app/website telemetry); and
  • From third parties (for example, social login providers or connected devices, if you choose to connect them).

  • Profile image or photo (if you choose to provide one)

B. Food and Activity Diary Data

Certain features allow you to voluntarily share information about your dietary habits and activities, including:

  • Dietary habits and dietary restrictions
  • Food, drink, and medications you consume
    • Including information submitted via voice logging
    • Including information about purchases via grocery integrations
  • Calorie count information
  • Fitness level, activity, and goals (for example, “lose weight”)
  • Lifestyle information (for example, sleeping data)
  • Body measurements (for example, height, weight, and BMI)
  • Information related to physiological conditions
  • Progress photos you choose to provide
  • Other information you enter in notes (for example, observations and reflections about progress and mindset)

Important: Food and Activity Diary Data may include sensitive personal information when it indicates or allows someone to infer a health condition.

C. Communications With MyEats

  • Contact details (such as name and email address)
  • The content of your communications with us (including customer support interactions and exchanges with personnel)
  • Content you provide to our Support Center chatbot

D. Community / Social Media / Forums Content

  • Content and related contact information you provide when you interact with our social media pages, online discussion groups, or public-facing community forums sponsored by or affiliated with MyEats

E. Information You Exchange With Other Users (“Friends” Features)

If you use the “Friends” tab or other social features, we may receive and process information you exchange with other MyEats users, such as:

  • Name, email address
  • Diary entries
  • Photos
  • Fitness goals and achievements

F. Research and Survey Information

  • Contact information, feedback, and other information you choose to provide if you participate in surveys or research initiatives

G. Events and Registration Details (If Applicable)

  • Registration information and participation details if you register for or attend events that we host or sponsor

I. Payment Information (Website Premium Subscription)

If you purchase a Premium Subscription through our website, you may be asked to provide payment information. MyEats does not directly collect or store your payment card information; it is collected and processed by a third-party payment platform we use to facilitate the transaction.

3.2 Information We Collect Automatically

When you use the Services, we may automatically collect Usage and Device Data, such as:

  • Browser type and settings
  • Device type and operating system
  • Cookie identifiers and similar IDs
  • Internet Protocol (IP) address
  • Mobile advertising identifier and other unique identifiers
  • Internet service provider or mobile carrier
  • General location information (including inferred location based on IP address)
  • Actions you take while using the Services (including frequency and duration of activity)
  • Links you click and interactions with pages or features

3.3 Cookies and Similar Tracking Technologies (Website)

We (and our third-party service providers and partners) use cookies and similar technologies (for example, pixels, web beacons, local storage objects, log files, and software development kits) on our website and Services for various purposes (collectively, “Cookies” or “Tracking Technologies”).

D. Business Partners

If we partner with other businesses to offer Services, we may receive personal information from those partners as needed for the purposes described in this Policy.

E. Other MyEats Users

If other users share content involving you (for example, shared achievements), we may receive that information through the “Friends” messaging channel or related social features.

F. Social Media Platforms (Social Login)

If you log in through a social media platform, we may receive information you have provided to that platform (subject to your social media settings), such as:

  • Name, email address
  • Profile picture
  • Friends list
  • Other profile information made available to us

G. Connected Health Devices and Health Repositories (With Your Permission)

If you choose to connect devices or repositories, we may receive relevant Food and Activity Diary Data from:

  • Connected devices such as heart rate monitors, continuous glucose monitoring devices, activity trackers, exercise equipment, scales, and/or wearables that integrate with the Services
  • Your device’s health and fitness repository, such as Apple HealthKit or Android’s Google Health Connect

Important statements about HealthKit / Health Connect / Samsung Health:

  • The information you provide to HealthKit is governed by Apple’s terms and privacy policy. The unique information you choose to send from HealthKit is not used by MyEats for marketing and advertising or transferred by MyEats to third parties for marketing and advertising.
  • The information you provide to Google Health Connect is governed by Android’s terms and privacy policy. The unique information you choose to send from Google Health Connect is not used by MyEats for marketing and advertising or transferred by MyEats to third parties for marketing and advertising.

3.5 Sensitive Personal Information and Health-Related Data

Some information we collect or you provide may be considered sensitive under applicable law. This can include information that reveals, relates to, or can allow inferences about health conditions (such as certain Food and Activity Diary Data and physiological information).
Where required by law, we will obtain your consent to collect or process sensitive personal information for certain purposes (for example, where a jurisdiction requires opt-in consent for use beyond providing the Services).

3.6 Aggregated, De-Identified, or Anonymized Information

We may aggregate, de-identify, or anonymize information so that it is no longer considered personal information under applicable law. We may use and disclose de-identified information for purposes consistent with this Policy or as otherwise permitted by law.
If we de-identify information, we will maintain and use it in de-identified form and will not attempt to re-identify it except as required or permitted by law.

4. How We Use Personal Information

We use personal information for the purposes described below:

4.1 Provide and Operate the Services

  • Create and manage your account
  • Provide core app features (including diary logging, insights, and integrations you enable)
  • Provide troubleshooting and technical support
  • Operate day-to-day business functions needed to deliver the Services

  • Respond to questions and requests
  • Send service-related and administrative messages (for example, changes to terms, conditions, or policies)
  • Request feedback or information to improve the Services

4.3 Respond to Privacy Rights Requests

4.4 Send Promotional and Marketing Communications

  • Send newsletters and promotional communications about features, offers, events, webinars, and other information about MyEats (with consent where required by law)

4.5 Targeted Advertising and Cross-Device Tracking

We engage in targeted advertising, which means:

  • You may see advertisements that are targeted and personalized to you on the Services; and/or
  • You may see advertisements for MyEats on third-party services based on information collected from and about you.

Tracking Technologies and attribution
We and our third-party partners may use Tracking Technologies to collect information such as IP address, cookie ID, mobile advertising ID, and activity information to deliver ads, measure performance, and understand whether ads lead to engagement.

Cross-device tracking
We and our third-party partners may use information we collect to help identify other devices you use (for example, phone, tablet, computer) so that advertising can be delivered, capped across devices, and measured across campaigns.

4.6 Analytics, Ad Performance, and Research

  • Analyze traffic and usage to understand how users engage with the Services

  • Prevent, detect, and investigate fraud, unauthorized activity, and misuse
  • Protect you, MyEats, and others from unlawful or unsafe activity

Important: If you post or make content available through public-facing or interactive features, that content may be available to others. Review your in-app settings to understand what you are sharing with “Friends” and what is public.

5.4 Marketing and Advertising Partners

We may disclose personal information (including device/browser information and usage/activity data) to marketing and advertising partners such as:

  • Social media platforms
  • Third-party advertising networks
  • Other parties that help serve, measure, and optimize ad campaigns

5.5 Analytics Providers

We may disclose personal information (including device/browser information and usage/activity data) to providers that help us measure and analyze Service performance and marketing effectiveness.

5.6 Research Partners

We may disclose personal information to research partners that perform surveys or research projects with us or on our behalf.

5.7 Corporate Transactions

If MyEats (or an affiliate) is or may be acquired, merged, invested in, reorganized, or if assets are transferred, personal information may be disclosed or transferred as part of that process, consistent with applicable law. We may also disclose information in advance to lenders, auditors, and advisors (including attorneys and consultants).

7. International Transfers of Personal Information

MyEats is headquartered in the United States and uses service providers in the United States and other countries. As a result, your personal information may be transferred to, stored, or processed in the United States and other countries that may have privacy laws that differ from those in your place of residence.

When we transfer personal information across borders, we do so in accordance with applicable law and take steps designed to protect your information. However, please note that when information is processed outside your jurisdiction, it may be subject to local laws that could allow government, court, law enforcement, or regulatory access in certain circumstances.

By using the Services and/or sharing personal information with MyEats, you understand that your personal information may be transferred to countries outside your country of residence.

8. User-Generated Content and Social Features

We may offer public-facing interactive features (such as community forums, discussion blogs, and similar features) that enable you to share information (for example, achievements, reviews, testimonials).

  • Any information you post to a public-facing section of the Services may be publicly viewable.
  • By posting, you acknowledge you have no expectation of privacy or confidentiality in the content you submit through these features, even if it contains personal information.

9. How We Protect Your Information

We maintain reasonable technical, organizational, and administrative safeguards designed to protect personal information under our control from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.
No security measures can guarantee complete security.

10. How We Retain Your Information

We retain personal information as long as necessary to fulfill the purposes described in this Policy, including to satisfy legal, accounting, or reporting requirements, unless a longer retention period is required or permitted by law.

When determining retention periods, we consider:

  • The amount, nature, and sensitivity of the information
